New Federal Biosecurity Reporting Obligations

Biosecurity Legislation Amendment (Miscellaneous Measures) Act 2018 No. 88 (Cth)

The Biosecurity Legislation Amendment (Miscellaneous Measures) Act 2018 No. 88 (Cth) (the Amending Act) has amended the Biosecurity Act 2015 (Cth) (the Act).

The Amending Act commenced in part on 1 September 2018.

Reporting obligations

The Amending Act has introduced two new reporting obligations into the Act for organisations that have control of certain goods, as follows:

  • Section 312B requires organisations that are in control of specified goods or a specified class of goods (suspended goods) that have been determined by the Director of Biosecurity under section 182(1) of the Act as being goods that must not be brought or imported into Australian territory for a specified period (the suspension period) (where the suspension period has not ended), to notify the Director of the location of the goods and of any other information specified by the Director that the organisation has in relation to the goods.
  • Section 312C requires organisations that are in control of specified goods or a specified class of goods (prohibited goods) that have been determined by the Director of Biosecurity and the Director of Human Biosecurity under section 173(1) of the Act as goods that must not be brought or imported into Australian territory, to notify the relevant Director of the location of the goods and of any other information specified by the Director that the organisation has in relation to the goods.

Failure to comply with the new notification requirements may result in the imposition of a civil penalty of 120 penalty units (currently $25,200).

Subscribers should note that currently there are no applicable determinations under section 182(1) or 173(1) of the Act.

Organisations should update their processes to ensure compliance with the additional reporting obligations as discussed above, and as highlighted in the NATIONAL – Biosecurity module.
