Various provisions of the National Disability Insurance Scheme Amendment (Securing the NDIS for Future Generations) Act 2026 (Cth) have commenced. NDIS providers and organisations delivering or facilitating NDIS supports will need to familiarise themselves with the amended definition of ‘NDIS provider’, the changes to functional capacity assessments, as well as new record-keeping requirements for claim-related records and the introduction of maximum pricing and provider inducement prohibitions.

In RHRD and National Disability Insurance Agency [2022] AATA 1766, the Tribunal considered whether requested supports were both reasonable and necessary under the National Disability Insurance Scheme Act 2013 (Cth).

New laws have commenced in South Australia, establishing a new regulatory framework governing the use of restrictive practices in the State.

In JLZT and NDIA [2022] AATA 541 (25 March 2022), the Administrative Appeals Tribunal overturned a decision to refuse an access request to the NDIS.
